1. Acceptance of Terms

By downloading, installing, or using Apertura Pro Cam ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

Apertura Pro Cam is a professional camera application for iOS that provides:

• Manual camera controls (ISO, shutter speed, focus, white balance)
• Multiple shooting modes (Photo, Video, Burst, Long Exposure, Night, Timelapse, AEB)
• Photo and video editing capabilities
• LUT (Look-Up Table) filters
• Professional overlays (histogram, focus peaking, zebras, spirit level)
• Photo Spots discovery feature for finding photography locations
• Geotagging capabilities

3. Location Services

Certain features of the App use location services:

• Photo Geotagging: Adds GPS coordinates to your photos
• Photo Spots: Discovers nearby photography locations using Apple MapKit
• Sun Times: Calculates sunrise, sunset, and golden hour for your location

Location services are optional. You may use the core camera features without enabling location access. Location data is processed on your device and is not transmitted to us or any third parties except as required by Apple MapKit for location searches.

4. Subscriptions and Purchases

Apertura Pro Cam offers optional premium features through in-app purchases:

• Subscriptions are billed through your Apple ID account
• Free trial periods, if offered, automatically convert to paid subscriptions unless cancelled
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's Settings → Apple ID → Subscriptions

All purchases are subject to Apple's App Store terms and conditions. Refunds are handled by Apple according to their refund policy.

5. User Content

You retain all rights to the photos and videos you create using the App. We do not claim any ownership or license to your content.

You are solely responsible for:

• The content you capture and create
• Ensuring you have permission to photograph subjects and locations
• Compliance with local laws regarding photography and recording
• Respecting others' privacy and intellectual property rights

6. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Capture content in locations where photography is prohibited
• Engage in any illegal or harmful activities
• Reverse engineer, decompile, or disassemble the App

7. Photo Spots Feature

The Photo Spots feature provides suggestions for photography locations based on publicly available map data. By using this feature, you acknowledge:

• Location suggestions are for informational purposes only
• We do not guarantee access, safety, or suitability of any location
• You are responsible for verifying that locations are publicly accessible and safe
• You must comply with all local laws, regulations, and property rights
• Some locations may require permits or permissions for photography
• Conditions at locations may change without notice

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability and fitness for a particular purpose
• Accuracy of location data, sun times, or photo spot suggestions
• Uninterrupted or error-free operation
• Compatibility with all devices or iOS versions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or photos
• Personal injury or property damage from visiting suggested locations
• Missed photo opportunities due to inaccurate sun times
• Any damages arising from use or inability to use the App

10. Intellectual Property

The App, including its design, features, and content (excluding your photos and videos), is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

11. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective when posted. Your continued use of the App after changes constitutes acceptance of the modified terms.

12. Termination

We reserve the right to terminate or suspend access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
